1. Introduction.

Welcome to Bringerparcel.com. By using Bringerparcel.com, you agree to these terms and conditions. Do not continue to use Bringerparcel.com if you do not agree to all the terms and conditions stated on this page.

2. Intellectual Property Rights

Unless otherwise stated, Bringer Corporation owns the intellectual property rights for all material on Bringerparcel.com. All intellectual property rights are reserved. You may access this from Bringerparcel.com for your own use subjected to restrictions set in these terms and conditions.

3. Use of Website

Bringerparcel.com is provided solely for the use of current and potential Bringer customers to interact with Bringer and may not be used by any other person or entity, or for any other purpose. Specifically, all shipping, tracking, rating, receiving invoices and remitting payment using electronic funds transfer ("EFT"), drop-off locations, identifying and preparing international documents, estimating duties and taxes, and other information and services may only be used by current and potential customers for their own shipments.

Bringer does not accept ideas, concepts, or techniques for new services or products through Bringerparcel.com. If such information is received, it will not be considered confidential and will be deemed free to use, communicate and exploit such information in any manner it chooses.

  1. Sign In and Sign Up
    1. You may choose to register on Bringerparcel.com to access features on Bringerparcel.com. Bringerparcel.com Sign In provides you with access to online services. The availability of these services varies by country. In the future, Bringer may add other features that may be accessed through Bringerparcel.com. In such an event, previously registered users will not be required to re-register.
    2. By registering on Bringerparcel.com, You agree to provide accurate and current information about yourself as prompted by Bringerparcel.com and maintain and promptly update your online profile information to keep it accurate and current.
    3. Some Bringerparcel.com services are being made available to customers based in some countries and not others. You agree to register only for Bringerparcel.com services offered on the Bringerparcel.com website for the country in which your account is based.
    4. When you register using Bringerparcel.com, you will enter a username and password. You are responsible for maintaining the confidentiality of the username and password, and you are responsible for all activities that occur under your user. You agree to (a) immediately notify Bringer of any unauthorized use of your user or credentials, and (b) ensure that you exit from your Bringerparcel.com session at the end of each visit.
    5. You acknowledge and agree that it may be necessary from time to time for Bringer to confirm the validity of the credit card information you provided to open your Bringer account. When this occurs, Bringer may request a temporary authorization hold for a nominal amount on your card. This authorization hold does not result in actual charges to your card. These authorizations will automatically expire based on guidelines established by your card issuer.
  2. Changes to website
    1. Bringerparcel.com and its content may be changed, deleted, or updated at any time without notice.

4. Shipments

The responsibility of proper descriptions, harmonized codes, quantities, and price accuracy are the responsibility of the BPS account holder (shipper). In the event the shipments are refused by Customs or regulatory agencies at country of destination, the shipping charges, additional fees, and return fees are obligations to be paid by the BPS account holder (shipper).

5. Restrictions

You are specifically restricted from all the following:

  1. Publishing any website material in any other media without prior consent.
  2. Selling, sublicensing, and/or otherwise commercializing any website material.
  3. Publicly performing and/or showing any website material.
  4. Using this website in any way that is or may be damaging to this website.
  5. Using this website in any way that impacts user access to this website.
  6. Using this website contrary to applicable laws and regulations, or in any way may cause harm to the website, or to any person or business entity.
  7. Engaging in any data mining, data harvesting, data extracting, or any other similar activity in relation to this website.
  8. Using this website to engage in any advertising or marketing.
  9. Using this website to provide information to, or prepare shipments by, or for the benefit of, third-party shippers.
  10. The use of non-authorized scripting technologies to obtain information from or submit information through Bringerparcel.com.

Certain areas of this website are restricted from being accessed by you. Bringer may further restrict access by you to any areas of this website, at any time, in absolute discretion. Any credentials you may have for this website are confidential and you must maintain confidentiality as well.

6. Links to other web sites

There are links on the Bringerparcel.com site that allow you to visit the sites of third parties. Neither these sites nor the companies to whom they belong are controlled by Bringer.

Bringer makes no representations concerning the information provided or made available on such sites nor the quality or acceptability of the products or services offered by any persons or entities referenced in any such sites.

Bringer has not tested and makes no representations regarding the correctness, performance or quality of any software found at any such sites. You should research and assess the risks which may be involved in accessing and using any software on the Internet before using it.

7. Notifications

Bringer provides you with the opportunity to use notifications to send a message to the recipient informing him/her of your shipment.

Bringer does not commit to keeping your message private or confidential. By using notifications, you acknowledge that Bringer is providing the technical functionality only, and that you are solely responsible for the content of your messages. Bringer undertakes no duty to monitor any messages sent by you. However, Bringer, in its sole discretion, may elect, but is not obligated, to look at your messages to protect itself.

Do not use notifications for anything other than to communicate information about your shipment. You may not use notifications to disseminate inflammatory, infringing, obscene, or other unlawful information, or to threaten, harass, abuse, or otherwise violate the legal rights of others or perform any act contrary to law. If Bringer sees or hears about messages sent via notifications that violate these provisions, or that may damage Bringer, it may take all actions necessary to protect itself, including disclosing any messages to the authorities.

It is not necessary to use notifications to ship a package. Bringer will not be liable for any failure or delay, for any reason, in the transmission, receipt, or acknowledgment of any messages sent by or to you.

8. Address Book

Subject to the terms listed here, addresses will remain in your Address Book as long as you use the site. If you do not use the site for a period of 6 months, Bringer may delete your Address Book. However, Bringer will not delete your account.

If you have any concerns, please email Bringer at bps@Bringer.com. The Address Book is a feature provided free of charge by Bringer. You should maintain a back-up copy of your addresses as Bringer will not be responsible for the loss of addresses contained in the Address Book. Bringer may modify or terminate this feature at any time for any reason.

9. Your Content

By using Bringerparcel.com, you agree to the following terms regarding the collection and use of your information:

  1. Information Collection: We collect various types of information, including but not limited to the shipper's name, recipient's name, address, telephone number, and email address.
  2. Data Usage: You agree that all information submitted on bringerparcel.com may be used by Bringer for data analysis purposes. This includes analyzing and improving our services, understanding user preferences, and other analytical activities to enhance the overall user experience.

10. No Warranties

This website is provided "as is," with all faults, and Bringer expresses no representations or warranties, of any kind related to this website or the materials contained on this website. Also, nothing contained on this website shall be interpreted as advising you.

11. Variation of Terms

Bringer is permitted to revise these terms at any time as it sees fit, and by using this website you are expected to review these terms on a regular basis.

12. Assignment

Bringer is allowed to assign, transfer, and subcontract its rights and/or obligations under these terms without any notification. However, you are not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these terms.

13. Services

Bringer Parcel Services offers parcel delivery and fulfillment services. These services are subject to these terms and conditions, as well as any additional terms and conditions that may apply to a specific service.

Our services and their specified terms and conditions:

  1. Provide accurate and complete information for delivery and billing purposes.
  2. Ensure that all parcels comply with applicable laws and regulations.
  3. Not use our services for illegal or unauthorized purposes.

15. Account Registration

To use our services, you need to create an account. You must provide accurate and complete information during the registration process and keep your account information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

16. Payment and Fees

  1. All fees for services must be paid in full according to the pricing structure outlined in the Bringer Parcel Services rate sheets. We reserve the right to change our fees at any time.
  2. Customs, Duties, & Taxes
    Recipients of international shipments may be subject to import taxes, fees, and customs duties, levied by the customs office of your shipping destination. These fees vary according to the customs regulations of the destination country.
    1. When shipping Delivered Duty Paid (DDP) the shipper bears the responsibility to pay for all fees, duties, and taxes in advance.
    2. When shipping Delivered Duty Unpaid (DDU) the recipient bears the responsibility to pay for all fees, duties, and taxes.
    3. Components that play a role in import taxes, fees, and customs duties calculations are (among others):
      • Product and price
      • Shipping costs and package weight
      • Customs clearance channel
      • Import taxes based on custom duty amounts
    4. The amount of actual import taxes, fees, and customs duties charged by customs authorities will vary depending on multiple factors. These include customs regulations in the given destination, the product category and price, and the shipping method selected. Customs policies vary widely, and some countries don't charge fees for shipments that fall below a minimum value “de minimis”. Contact the customs office of the destination country for more information.
    5. Shortage or Overage
      • Shortage: When there is duty/tax shortage, meaning that the amount invoiced is insufficient to pay customs, the shipper or consignee will be invoiced the difference.
      • Overage: When there is duty/tax overage, meaning that the amount invoiced is over the amount charged by customs, the shipper or consignee will be refunded the difference.
    6. Admin Fee is charged to process financial transactions with customs agencies, ensuring timely and accurate payment of duties and taxes assessed.
    7. Failure of Proper Declaration
      • It is the account holder’s (i.e. shipper) responsibility to provide a proper declaration of what they are shipping in terms of the item description, harmonized code, quantity, price, etc. If customs or other regulatory agency refuses entry of a parcel due to improper declaration, all charges, additional fees, and returning fees are obligated to be paid by the account holder.
  3. Collections

    Bringer Parcel Services reserves the right to send an outstanding balance to a Collections agency to seek reimbursement if the account holder fails to pay their dues within their credit terms.

  4. Payment Accounts

    Bringer Parcel Services offers three (3) payment accounts.

    1. Prepaid Account – Charged and paid at the time service is rendered.
    2. Credit Account – Charged at the time service is rendered with a set number of days to pay the balance.
      1. 15 days
      2. 30 days
      3. 60 days
      4. 90 days
    3. Deposit Account – Charged at the time service is rendered to the balance that is deposited.

17. Dangerous Goods and Perishable Shipments

  1. Dangerous Goods

    Bringer Parcel Services offers transportation of dangerous (hazardous) goods (1) in passenger aircraft quantities prepared according to the requirements set forth in the Code of Federal Regulations Title 49, and (2) hazardous materials that comply with the requirements set forth in the of Federal Regulations Title 49.

    For each hazardous materials package requiring shipping papers under 49 C.F.R. Section 172.200, an additional charge, as stated on the current rate sheet, will be applied. If a hazardous materials package is refused by the consignee or if it is damaged, the package will be returned to the shipper, if possible. Bringer Parcel Services reserves the right to charge the shipper for all costs resulting from improperly packed hazardous materials, or the cost of disposal of the package if the shipper refuses to accept a returned item.

  2. Perishables

    Bringer Parcel Services does not provide protection for perishable commodities or commodities requiring protection from heat or cold. Such commodities will be accepted for transportation solely at the shipper's risk for damage caused by exposure to heat or cold.

18. Additional Handling Charge

Additional handling charges may be assessed.

This charge applies to the following:

  • Any article that is encased in an outer container or packing material made of metal or wood.
  • Any item that is not fully encased in a corrugated cardboard shipping container (such as a barrel, drum, pail, or tire).
  • Any package with the longest side exceeding 48 inches or its second-longest side exceeding 30 inches.

Additionally, Bringer Parcel Services reserves the right to assess an additional handling charge for any package that, in Bringer Parcel Services’ sole discretion, requires special handling. This additional handling charge may be applied to all packages, regardless of the service level.

19. Refusal of Packages

Bringer Parcel Services reserves the right to refuse any package which it deems as dangerous or other, if in the judgment of Bringer Parcel Services, can taint or otherwise damage other merchandise or equipment, or which is economically or operationally impracticable to transport, or which is improperly packed or wrapped. Packages must be packed to meet standards set forth by the International Safe Transit Association. Common fireworks are not accepted by Bringer Parcel Services for transportation.

20. Export Responsibilities

You assume all responsibility for compliance with all laws and regulations of the United States and any other country from which you may access bringerparcel.com regarding access, use, export, re-export and import of any content appearing on or available through bringerparcel.com.

You acknowledge and agree that you will not export or import any content to any country to which export or import is restricted under United States law, that you are not a national of any such country, you are not a Denied Party listed on the U.S. Denied Persons List, you are not a Special Designated National on the U.S. Treasury Department's list of Specially Designated Nationals, and that the Content will not be used in the design, development or production of nuclear, chemical or biological weapons.

21. Terms of Carriage

  • You agrees that domestic and international carriage by Bringer Parcel Services of any shipments tendered to Bringer Parcel Services shall be in accordance with the terms, conditions and limitations of liability set out on the NONNEGOTIABLE Air Waybill, Label, Manifest, or Pick-Up Record (collectively "Shipping Documentation") and as appropriate any transportation agreement between customer and Bringer Parcel Services covering such shipment and in any applicable tariff, service guide or standard conditions of carriage, copies of which are available upon request, and which are incorporated into this Agreement by reference. If there is a conflict between the Shipping Documentation and any such document then in effect or this Agreement, the transportation agreement, tariff, service guide or standard conditions of carriage, or this agreement will control, in that order of priority. If a shipment originates outside the United States, the contract of carriage is with the Bringer Parcel Services subsidiary, branch, or independent contractor who originally accepts the shipment. Your use of the site shall not alter your responsibility for the preparation and accuracy of shipping documentation including import/export forms.
  • In the event you use the site to process shipments tendered to Bringer Parcel Services for delivery to locations outside the United States or country of shipment origin, you will, assure that the terms and conditions of international carriage supplied by Bringer Parcel Services from time to time (and which may be amended or modified from time to time at Bringer Parcel Services’ sole discretion) are placed on the Shipping Documentation as may be instructed by Bringer Parcel Services, for all such international shipments. You will defend, indemnify and hold harmless Bringer Parcel Services, its officers, directors, employees and agents from and against any and all losses, damages, claims and other items of cost and expense arising out of your failure to apply the international carriage terms to the Shipping Documentation for such international shipments, including without limitation claims from the recipient of any shipment, and your failure to follow Bringer Parcel Services’ instructions in regard to the placement of the terms on the Shipping Documentation for such international shipments.
  • You acknowledge that if the site is used to process shipments to locations outside the United States or country of shipment origin, you must enter the name of the person completing the Shipping Documentation to print in lieu of its manual signature on the Shipping Documentation, as applicable, for all shipments tendered by you to Bringer Parcel Services. You further acknowledge that such printed name shall be sufficient to constitute your signature, and your acceptance of Bringer Parcel Services’ terms and conditions of carriage contained in the applicable transportation agreement, tariff, Service Guide, Standard Conditions, or Shipping Documentation, under which the shipment is accepted by Bringer Parcel Services, or its independent contractor.
  • Unless otherwise indicated, the shipper's address indicated on the face of any Shipping Documentation is the place of execution and the place of departure and the recipient's address listed on the face of the Shipping Documentation is the place of destination.

22. Service Modifications

Bringer Parcel Services reserves the right to modify or discontinue any part of its services at any time without prior notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the services.

Bringer Parcel Services reserves the right to change the service or return a shipment in the event that the shipper has selected a service that is incompatible or exceeds the limits of the selected service.

23. Limitation of Liability

Use of Bringerparcel.com and its content is at your sole risk. Bringer will in no event be liable to you or any person or entity claiming through you for any direct, indirect, consequential, incidental or other damages under any theory of law for any errors in or the use of or inability to use bringerparcel.com and its content including without limitation, damages for lost profits, business, data, or damage to any computer systems, even if you have advised Bringer of the possibility of such damages.

In no event shall Bringer, nor any of its directors, and employees, be held liable for anything arising out of or in any way connected with your use of this website whether such liability is under contract. Bringer, including its directors, and employees shall not be held liable for any indirect, consequential, or special liability arising out of or in any way related to your use of this website.

To the fullest extent permitted by law, Bringer Parcel Services will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Any governmental agency delay, such as labor strikes.
  • Any service failure is caused by Bringer Parcel Services directly.
  • Political unrest.
  • Third party operations or labor strikes.
  • Force majeure

24. Indemnification

You agree to indemnify and hold harmless Bringer Parcel Services, its affiliates, and their respective directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Services or your violation of these terms.

25. Termination of Use

Bringer may discontinue, suspend, or modify Bringerparcel.com at any time without notice, and may block, terminate or suspend your and any user's access to Bringerparcel.com at any time for any reason in its sole discretion, even if access continues to be allowed to others.

26. Ownership

Bringerparcel.com and its content are protected by United States and international copyright, trademark, and other laws. © 2024 Bringer Corporation. All rights reserved. Specifically, Bringer does not convey to anyone, through allowing access to Bringerparcel.com, any ownership rights in Bringerparcel.com or in any Content appearing on or made available through Bringerparcel.com. Customers may not copy, modify, translate, transmit, distribute, adapt, reproduce, decompile, reverse engineer, or disassemble any part of Bringerparcel.com or its Content.

27. Governing Law

This Agreement and your use of Bringerparcel.com is governed by and construed in accordance with the laws of the United States and the State of Florida, excluding its conflict of laws provisions. If for any reason a court of competent jurisdiction finds any provision of this Agreement, or a portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible.

Any cause of action with respect to Bringerparcel.com or this Agreement must be instituted within one year after the claim or cause of action has risen or be barred and must be brought in a court of competent jurisdiction within Miami-Dade County, Florida. This Agreement may not be changed or modified without the written consent of Bringer Corporation.

28. Severability

If any provision of these terms is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein.

29. Entire Agreement

These terms and conditions, together with any additional terms to which you agree when using elements of the services, constitute the entire agreement between you and Bringer Parcel Services regarding the use of the services.
